Terms of service

These terms are an agreement between you and Stillbrook Portraits LLC ("we", "us", "our"). They apply when you use stillbrookportraits.com, our free preview tool, our Etsy shop, or buy from us. By uploading a photo or placing an order, you agree to them. We have tried to keep them plain.

1. What we make

We make custom pet portraits from your photos. Each portrait is a digital illustration created with AI tools from your photo. A person on our team checks it before it is printed. Our print partner prints it on canvas or paper, or we deliver it as a digital file.

Our portraits are not painted with a brush. The styles are illustration styles (for example, a watercolor style), not the physical medium.

2. Your photos

You have the right to use them. When you upload a photo, you confirm that you took it, own it, or have permission to use it for a portrait, and that it doesn't break anyone else's rights.

The license you give us. You give us a non-exclusive, royalty-free license to use your photo only to create, show you, print, deliver, reprint and support your portrait, including sending it to the companies that help us do that (listed in our Privacy Policy). This license ends when we delete the photo on the schedule in our Privacy Policy.

Marketing only if you say yes. We will show your photo or your finished portrait in our marketing only if you give separate permission, for example by ticking an optional box or replying yes to our email. You can withdraw that permission at any time by emailing hello@stillbrookportraits.com, and we will stop using it in new material.

Photos we can't use. We may decline a photo that is too small or blurry, shows no clear pet, or is inappropriate. We may also decline any request we believe infringes someone else's rights.

3. Free previews

  • Previews are free. You don't pay anything until you choose to order.
  • To keep previews free for everyone, we limit how many you can make. Right now that is up to 6 per device per day. When you reach the limit you can still order the version you like best and add a note so we refine it before printing, or write to us if you need more. We may change these limits.
  • Previews carry a watermark. The watermarked preview is for you to look at, not for printing or reselling.
  • Portraits of 3 pets, other animals, or previews made while our instant tool is busy are prepared by our team and emailed to you.
  • Previews you don't order are deleted after 30 days.

The order button approves your preview. Right above it, you see this line:

"By ordering, you approve this preview for printing. It's made with AI and covered by our remake-or-refund guarantee."

If your portrait has a name or dates on it, the line reads:

"By ordering, you approve this preview for printing, including the spelling of the name and dates. It's made with AI and covered by our remake-or-refund guarantee."

Pressing the order button means we will print the preview you approved, and that you accept section 6 and our Refund and Replacement Policy (linked from that line as "Full terms"). Because your portrait is made just for you, it can't be returned for a change of mind. You can still cancel for a full refund before it goes to print, and our guarantee still applies: a free replacement if it arrives damaged or misprinted, a free remake within 30 days if it doesn't feel like them, and a full refund if the remake still isn't right. We keep a record of that approval, including which wording you saw (see our Privacy Policy).

If you leave a refine note, we make the change and email you a proof. We print only after you approve that proof (on the proof page you tick a box that says "I've checked my preview. Please print it. I understand it's made with AI and can't be returned for a change of mind.").

Small differences. The final print is made at a higher resolution from the preview you approved. It will match closely, but small details such as texture and fine lines can differ slightly. Colors on a printed canvas or paper can look a little different from your screen.

Names and dates. Please check the spelling of names and memorial text before you approve. We print what you gave us.

5. Orders, prices and payment

  • Prices are in US dollars and shown before you pay. We ship to US addresses only.
  • We may cancel an order and refund it in full if we can't make or ship it, for example if a price was shown in error.
  • If you pay with PayPal or a card, the payment company's own terms also apply.
  • Sales tax is added at checkout where required.

6. Refunds, remakes and replacements

Because every portrait is made for you, it can't be returned for a change of mind after you approve it. You can still cancel for a full refund until it goes to print (see Canceling below), and our guarantee applies:

  • Free preview and refine before you pay.
  • Free replacement if it arrives damaged or misprinted (report within 30 days of delivery, with a photo).
  • A free remake within 30 days of delivery if it doesn't feel like them, and a full refund if the remake still isn't right (tell us within 30 days of the remake's delivery). You keep the portrait. Digital files included.

Canceling. If you email us before your portrait is sent to print, we will cancel and refund your order in full. We check and send each portrait to print within 1 business day, so please write quickly. Once printing has started, we can't cancel it, but the guarantee above still applies.

7. Using your portrait

Personal use. You may use your portrait for personal, non-commercial purposes: hang it, share it with family and friends, post it on your own social media, use the digital file as a phone wallpaper, or print extra copies for yourself.

Not for resale. Please don't sell your portrait, or products made from it, or use it to promote a business without asking us first.

About copyright. Because the illustration is created with AI tools, it may not be protected by copyright, and we can't promise that you or we own a copyright in it. We don't claim any right to stop you using your own portrait for personal purposes. We keep the right to use our own style samples, templates and brand.

8. Digital files

Digital file orders include a square 4K image file and a phone wallpaper, sent by email as a download link that works for 30 days. Please save your files when they arrive. If a link expires, email us and we will send a new one while we still hold the file (see our Privacy Policy for how long).

9. Gift cards

Gift cards are sold and redeemed through our Shopify store. They can be used toward any portrait at stillbrookportraits.com. They do not expire and can't be exchanged for cash, except where the law requires. Treat a gift card like cash: we can't replace one that is lost or used by someone else, unless the law requires it.

10. Discount, partner and affiliate codes

  • One discount code per order unless we say otherwise.
  • Codes have no cash value and may have an end date, which we show with the code.
  • Partner and affiliate codes (for example from a pet crematory, veterinary clinic, rescue or creator) may give you a discount, or may mean the partner earns a commission or a donation is made. The partner's own page or card tells you which.

11. Delivery

Delivery dates are estimates shown before you pay. They depend on our print partner and the carrier. We will keep you updated and help if something goes wrong. See our Shipping Policy.

12. Acceptable use

Please don't upload photos that are illegal, hateful, sexual, or that you don't have the right to use. Please don't try to get around preview limits, overload our systems, or use our tool to make images of people instead of pets. We may block access if this happens.

13. Limitation of liability

To the extent the law allows:

  • Our total responsibility for any claim about an order is limited to the amount you paid for that order.
  • We are not responsible for indirect or consequential losses, such as a missed event, as long as we have acted in good faith.
  • Our preview tool and website are provided "as is". We work hard to keep them running but can't promise they will always be available or error free.

Nothing in these terms limits rights you have under consumer protection laws that can't be waived.

14. Disputes

If something goes wrong, please email hello@stillbrookportraits.com first. We reply within 1 business day and most problems are solved quickly. If we can't solve it together, any dispute will be handled in the state or federal courts located in Wyoming, or in small claims court where you live if you prefer.

15. Governing law

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules.

16. Changes

We may update these terms. The version that applies to your order is the one posted when you placed it. We'll update the date at the top when we change them.
